Amundson Terms of Use & Privacy Policy

Welcome to Amundsonsup.com (the “Site”). Amundson and its wholly-owned subsidiaries and parent company provide their services to you subject to the following terms & conditions. ("Terms and Conditions" or "Agreement").  This policy describes how Amundson and its parent, subsidiary, and affiliate companies collect, use and share information collected globally through our social media platforms, the mail, dealers, distributors, retail stores where our products are sold, wholesale accounts, Amundson.com and any other websites that link to this privacy policy (collectively, the “Amundson Services”). Please read the following terms and conditions carefully before using our Site. By using or accessing the Site or services, you signify that you have read, understand and agree to be bound by these Terms and Conditions. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE AND OUR PRIVACY POLICY; IF YOU DO NOT AGREE, DO NOT USE THE SITE.

Electronic Communications

When you visit Amundsonsup.com or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail, text, or chat. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Children Under the Age of 18

Amundson does not sell products to children, but it sells them to adults, who can purchase products with a credit card or other electronic payment services such as Pay Pal. If you are under 18, you may shop at Amundson.com only with involvement of a parent or guardian. Amundson and its affiliates reserve the right to refuse service, remove or edit content, or cancel orders in their sole discretion.

The Digital Millennium Copyright Act

The Digital Millennium Copyright Act of 1998 (the "DMCA") provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. This Site or any portion of this Site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Amundson. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Amundson and our affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilizing Amundson’s name or trademarks without the express written consent of Amundson.

Trademarks

Amundson and other marks indicated on our Site are registered trademarks of Amundson in the United States and other countries. Amundson graphics, logos, page headers, button icons, scripts, and service names are trademarks or trade dress of Amundson. Amundson’s trademarks and trade dress may not be used in connection with any product or service that is not Amundson’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Amundson. All other trademarks not owned by Amundson that appear on this Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Amundson.

Indemnification

You agree to indemnify, defend, and hold harmless Amundson, its affiliates, officers, directors, employees, agents, and suppliers from and against all claims, demands, expenses, damages, and costs, including reasonable attorney’s fees, resulting from your use of this Site, your conduct in connection with the Site, or your violation of these Terms & Conditions, any law or the rights of any third party.

Amundson may link to third-party sites. Amundson has no control over linked sites. These sites are for your convenience only and must be accessed at your own risk.

Risk of Loss

All items purchased from Amundson are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Product Descriptions

Amundson attempts to be as accurate as possible. However, Amundson does not warrant that product descriptions or other content of this Site is accurate, complete, reliable, current, or error-free. If a product offered by Amundson itself is not as described, your sole remedy is to return it in a new, unused condition.

Disclaimer of Warranties and Limitation of Liability

This site is provided by Amundson on an "as is" and "as available" basis. Amundson makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk.

Applicable Law

By visiting Amundson.com, you agree that the laws of Washington, a state that is part of the United States of America without regard to principles of conflict of laws, will govern these Terms & Conditions and any dispute of any sort that might arise between you and Amundson.

Disputes

Any dispute relating in any way to your visit to Amundson.com or to products you purchase through Amundson.com shall be submitted to confidential arbitration in the state of Washington. To the extent you have in any manner violated or threatened to violate Amundson's intellectual property rights, Amundson may seek injunctive or other appropriate relief in any state or federal court in the state of Washington and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this Agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Site Policies, Modification, and Severability

We reserve the right to make changes to our Site, policies, and these Terms & Conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Collection of Personal Information

We will ask you when we need information that identifies you individually or allows us to contact you directly (personal information). We may ask for personal information when you purchase a product, enter a contest, request a service, complete a survey, subscribe to news, or engage in some other activity on our site. In connection with these activities, we may ask you for contact information such as your name, telephone number, and email address. When you visit our website, we collect standard information about your hardware and software such as your IP addresses, browser type, operating system, pages visited on our site, referring and exit pages, and the dates and times of the visits. This site visitation data is used to administer the site and provide general statistics regarding the use of Amundson.com. Site visitation data is never linked to your personal information, and we do not use it to identify you individually without your permission.

Google Analytics

Amundson.com uses a tool called Google Analytics Demographics and Interest Reporting and may also make use of other Google Analytics for Display Advertising tools, including Remarketing, Google Display Network Impression Reporting and/or the DoubleClick Campaign Manager integration. We are required by Google to disclose the following information to you in our Privacy Policy in connection with our use of any Google Analytics for Display Advertising tools:

1. You may opt out of Google Analytics for Display Advertising by using the Google Ads Settings page. You may also prevent your data from being collected and used by Google Analytics by opting out through the use of the Google Analytics Opt-out Browser Add-on.

2. If Amundson.com makes use of the Google Analytics for Display Advertising Remarketing feature, Amundson will use such Remarketing feature to advertise online, and third party vendors, including Google, may show Amundson ads on sites across the Internet.

 

3. Amundson and third party vendors, including Google, may use first-party cookies (such as the Google Analytics cookies) and third party cookies (such as the DoubleClick cookie) together to (a) inform, optimize and serve ads based on a user’s past visits to Amundson.com, and/or (b) report how your ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to visits to Amundson.com.

Google Analytics collects only the IP address assigned to you on the date you visit Amundson.com, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Data from Google Analytics Demographics and Interest Reporting may be utilized by Amundson to help recognize and understand user preferences, to make improvements to Amundson.com, to choose content and advertising to display to you, and for other business purposes that will allow Amundson to better serve you.

Security of the Information We Collect

We are committed to protecting the security of your personal information, and we use a range of technologies and procedures to protect your personal information. For example, we store personal information in a secure, limited access facility; sensitive information transmitted to us through our store (such as a credit card number) is encrypted for transmission using the Secure Socket Layer (SSL) protocol. The SSL encryption is designed to make the information unreadable by anyone but us and our payment service providers.

Protection of Children's Privacy

Amundson.com is a general interest website, and we do not knowingly collect any personal information from children. Amundson.com does not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use Amundson.com only with the involvement of a parent or guardian.

Use of Cookies and Clear GIF Technology

When you visit our site, a cookie may be saved on your computer (if your computer accepts cookies), and if you return to the site the cookie may be read. Limitation of Liability

Except where prohibited by law, in no event will Amundson be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if Amundson has been advised of the possibility of such damages.  Amundson provides unique access to several international distributors and dealers and the site therefore may contain references or cross references to Amundson products, programs and services that are not announced in your country. Such reference does not imply that Amundson in your country intends to announce such products, programs or services.

Children Under the Age of 13, Read This: Amundson is committed to protecting the online privacy of children. In accordance with the Children's Online Privacy Protection Act, we will not knowingly collect any information from children under the age of 13. Amundson.com does not sell products for purchase by children. We sell children's products for purchase by adults.

Information You Post

Amundson reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product or service to any person or geographic area. We at Amundson are pleased to hear from our loyal fans and welcome your comments regarding our products and services. Unfortunately, however, our company policy does not allow Amundson to accept or consider creative ideas, suggestions, or materials other than those that we have specifically requested.
